Pogo Linux currently warrants all server products for three (3) years, parts and labor. Workstations are warranted for two (2) years, parts and labor. All third party items, such as monitors, are governed by the individual manufacturers warranties. Pogo Linux does not provide warranty coverage of any kind to any Open Source software that is preloaded on your system.

Users will occasionally wish to modify their systems by adding, removing, or exchanging internal system components. This is permissible in most cases as long as an email is first sent to to explain what modifications will be made - only then will the warranty be honored. Additionally, we may be able to inform you of any issues you may encounter when adding the new hardware. We will always go out of our way to help you solve non order-related hardware and software issues that arise, but that level of support will be made at our discretion.

Pogo Linux Standard Warranty

Pogo Linux warrants server hardware products to be free from defects in materials and workmanship for a period of three (3) years from the date of invoice. Workstation products are warranted for two (2) years. This warranty is not transferable. Any damage the product is subjected to during shipment is also covered, providing the system is shipped with packaging methods and materials approved by Pogo Linux.

Exclusions: Pogo Linux does not warrant damage due to external causes including, but not limited to, accident, abuse, misuse, problems with electrical power, failure to maintain environmental conditions within operating range specified by manufacturer, relocations or attempts to relocate systems, servicing not authorized by Pogo Linux, usage not in accordance with product instructions, failure to perform required preventive maintenance, and problems caused by use of parts and components not supplied by Pogo Linux. Pogo Linux hardware products are not warranted, implied or otherwise, as to their merchantability or fitness for a specific purpose.

External Accessories: Devices (such as monitors, uninterruptible power supplies, tape drives, speakers and rack enclosures) are warranted only by manufacturer's policy.

All peripheral devices, which include such items as speakers and monitors, are not warranted directly by Pogo Linux. These items only carry their individual manufacturers warranties. Additional components may be added or removed from the system without voiding the warranty if Pogo Linux Support is contacted first to approve the modifications, and inform the customer of potential issues.

Software: Pogo Linux systems with Linux only include software that is licensed free under the GPL public license. As no licensing fee is passed on to the consumer, Pogo Linux makes no claims or warranties, either express or implied, of any kind, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, to the extent permitted by law. Customer assumes entire risk as to the quality and performance of the software. Pogo Linux is not liable for any damages including, but not limited to, loss or corruption of data.

Pogo Linux systems that are dual boot with a licensed copy of Windows have no software support for Windows issues. The warranty for the Windows product can be found at www.microsoft.com.

POGO LINUX'S RESPONSIBILITY FOR DEFECTS IN MATERIALS AND WORKMANSHIP IS LIMITED TO REPAIR OR REPLACEMENT AS SET FORTH IN THE WARRANTY. This warranty supercedes all other warranties, express or implied.

Limitation of Liability: POGO LINUX DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SETFORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCTS NOT BEING AVAILABLE FOR USE OR FOR LOST OR CORRUPTED DATA. POGO LINUX IS NOT LIABLE FOR LOST PROFITS, LOST BUSINESS, OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES. UNDER NO CIRCUMSTANCES IS POGO LINUX LIABLE FOR ANY THIRD- PARTY CLAIMS AGAINST THE CUSTOMER.

Some states/countries do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Some states/countries do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state and country to country.

Customer Obligations: Customer agrees to comply with all applicable state and federal laws and regulations. Products are subject to United States export laws and may be subject to export and import laws of other countries. Customer will strictly comply with such laws. Customer warrants being the end user. Separate terms and conditions apply to reseller/OEM agreements.

Governing Law: This agreement and any order issued here under shall be governed by the laws of the State of California. The application of the United Nations Convention on Contracts for International Sale of Goods is expressly excluded. The parties hereby agree and consent that any dispute relating to the products sold here under shall be subject to exclusive jurisdiction and venue of the United States District Court for the Northern District of California, Union City, and the Superior and Municipal Courts of the State of California, Alameda County.
